Terms of Service

1. What Charon is

Charon is a service operated by Klapen LLC. Charon delivers fan-built corvettes inside No Man's Sky on behalf of customers via an automated bot that joins your in-game multiplayer session.

Important framing: Charon sells the bot's delivery service, not the corvettes themselves. Corvettes in the catalog are fan-built community contributions; they remain free to share. What you pay for — through subscription tiers or one-off delivery tokens — is the bot's labor of in-game delivery.

This framing matters because directly selling in-game assets to other players for real money is restricted by Hello Games' End User License Agreement. Charon does not sell in-game assets. The service-versus-asset distinction is intentional and load-bearing.

2. Account & eligibility

You must be at least 13 years old to use Charon (or older if your country requires a higher minimum). You must have a No Man's Sky copy on a supported platform and the ability to sign into Discord.

You agree to give accurate information when you sign up and to keep your account credentials reasonably secure. You're responsible for activity on your account.

3. Subscriptions, tokens, allotments

Charon offers four subscription tiers (Drifter free / Crewmate / Captain / Patron of the Crossing), each with a weekly allotment of deliveries. Allotments reset weekly. They do not roll over. Tier changes apply mid-week for upgrades (immediately) and at the next renewal for downgrades.

Delivery tokens are one-off, never expire, work on any ship in the catalog, and can be purchased by any tier including free Drifter. Token packs are listed at /tokens/; current prices are subject to change with notice.

Cancellation is immediate and effective at the end of the current billing period. Already-paid time is not pro-rated or refunded except as described in Section 5.

4. Catalog and uploads

Anyone with an account can upload corvettes. By uploading, you grant Charon a non-exclusive license to host, display, and deliver your ship via the service. You retain ownership; you can remove your uploads at any time from your account.

You're responsible for the legality of what you upload. Don't upload anything you don't have the right to share. See the Builder Code for community guidelines.

Charon may remove or refuse to deliver any ship that violates the Code or these Terms, with notice to the uploading builder.

5. Refunds & comps

Refunds are manual and case-by-case. Charon does not issue automatic refunds. If a delivery fails on Charon's side — bot didn't show, build was incomplete, ship looks wrong — you can submit a delivery issue ticket and the mod team will review.

The mod team's decision is final. Common comps include re-running the delivery for free or issuing a token. Charon does not refund:

• Crashes traced to your PC, console, or save file
• ISP outages or connectivity drops on your side
• Save corruption that occurred outside the active delivery window
• Buyer's remorse after a successful delivery
• Subscription time already consumed (cancel anytime; next period stops billing)

For statutory consumer-protection rights in your jurisdiction (UK Consumer Rights Act, EU consumer law, etc.), those rights apply on top of and supersede any conflicting clause above.

6. What's prohibited

Don't:

• Use Charon to harass other players or distribute malicious content
• Attempt to reverse-engineer, scrape, or overload the service
• Resell access to your account or your delivered ships
• Impersonate other builders or claim work that isn't yours
• Use the bot's friend-code or session join for purposes other than receiving your own ordered delivery

Violations may result in delivery refusal, account suspension, or permanent ban. See Builder Code section 8 for the graduated approach the mod team uses.

7. Third-party game terms

Charon operates inside No Man's Sky, a third-party game published by Hello Games. Your use of NMS is governed by Hello Games' own terms, which Charon is not party to. Charon is designed to work with NMS's built-in multiplayer system — the same network feature any human player uses.

Charon does not modify your save file from the outside; the bot interacts with your session as a guest player with edit permission, the same way a friend joining your game would. We can't and won't promise Hello Games' ongoing tolerance of the bot; if a future NMS update breaks the delivery mechanism, Charon will pause deliveries until it can be re-enabled (or refund pre-paid time per Section 5).

8. Disclaimers & liability

Charon is provided "as is" and "as available." We don't warrant uninterrupted service, error-free operation, or that any specific delivery will succeed. We try hard at all three, but the bot operates over the public internet and inside a third-party game; small failures happen.

Charon's aggregate liability for any claim arising from your use of the service is capped at the total amount you paid Charon in the 12 months before the claim, or USD $100, whichever is greater. To the maximum extent permitted by law, Charon disclaims liability for indirect, consequential, incidental, or special damages.

Nothing in this section limits liability for things that can't be limited under applicable law (gross negligence, willful misconduct, statutory consumer rights, etc.).

9. Termination

You can close your account anytime from your account dashboard. Closure stops future billing immediately and removes your data per the Privacy Policy.

Charon may suspend or terminate your account for material violation of these Terms or the Builder Code, with notice where practical. Suspensions for safety reasons (Section 3 of the Builder Code, e.g. exploitative content, abuse) may be immediate.

10. Governing law & disputes

These Terms are governed by the laws of [state pending — likely Texas or Klapen LLC's state of formation], without regard to conflict-of-laws principles. You and Charon agree to attempt good-faith resolution of any dispute through the Discord mod team first, then through informal correspondence, before any formal action.

If a dispute can't be resolved that way, it'll be brought in the appropriate state or federal court located in [venue pending]. If you're a consumer in a jurisdiction with stronger statutory venue protections, those apply.

11. Changes

If these Terms change meaningfully, the "Last revised" date updates and active users get notice through the email or Discord DM channel they've authorized. Continued use after notice means acceptance. If you don't accept, close the account; Section 5 applies.
